Pre-contractual information
pursuant to articles 48, 49 and 51 of the Consumer Code (Legislative Decree No. 206 of 2005)

This document provides pre-contractual information (“Pre-contractual Information") pursuant to articles 48, 49 and 51 of the Italian Consumer Code (Legislative Decree No. 206/2005) for the authentication and/or grading service executed by AiGrading (“AiGrading”) through the login in the reserved area of the AiGrading site (“Site”).

This document does not constitute the contract nor contains the general conditions of the contract but only the Pre-contractual Information that are provided to the Customer before the conclusion of the contract. To conclude the contract and submit the order, please continue in this Site and finalize the submission list.

1) MAIN CHARACTERISTICS OF THE AUTHENTICATION SERVICE

The main features of the authentication service is to verify the authenticity of the collectible, in other words, to ensure that the item is truly produced by the official manufacturer (for example, that a Pokemon card was actually and authentically sold by Pokemon).

2) MAIN CHARACTERISTICS OF THE GRADING SERVICE

The main features of the grading service is to grade cards from different card games like Pokemon, Magic and other collectibles, on a scale from 1 to 10, using industry standard methods and criteria, keeping in mind that the rating can always be negative i.e. the collectible can be judged “not gradable”. The Collectible can be evaluated “not gradable” for the following reasons:

  1. "poor conditions, not possible to be graded", if the collectible-physical object – in the unquestionable judgment of AiGrading - is considered worn or damaged to such an extent that the judgment is substantially equal to zero.
  2. "falsified", if the Collectible – in the unquestionable judgment of AiGrading - is false.

In the case of a collectible judged “not possible to be graded", it will be sent back but the price of the service will not, however, be returned because the grading service has been, however, correctly executed.

In cases of "mismatch", i.e. collectible incorrectly classified by the Customer, AiGrading will define the correct classification and will send it back to the Customer with the relative grading judgment.
The purchasing procedure of the grading service requires the Customer to declare the value of the card to be graded.

At the end of the service, AiGrading will generate a grading certificate available only and exclusively in digital format, whose essential data are registered on AiGrading's proprietary database and accessible through the front-end of this Site.

4) PRICE OF THE AUTHENTICATION/GRADING SERVICE

The total price of the authentication and/or grading service is available for consultation on this Site.

5) METHOD OF PAYMENT, DELIVERY AND EXECUTION OF THE SERVICE

The payment will be done at the conclusion of the purchasing process through the Site which uses the Paypal online payment system. Customers who have a Paypal account will be able to use their Paypal account reserve or, if they don’t have one, they will be able to use their credit card without the need to open a Paypal account. In any case, the credit card data will not be communicated to AiGrading.

6) SHIPPING AND RETURN OF THE COLLECTIBLE

The Collectibles to be graded can be deliverd by the Customers by mail only, at their own expense or by means of the collect service offered by AiGrading at the cost stated in the ordering procedure. The Customer remains, however, solely responsible for damages to the collectibles that may occur during the transportation and until the collectibles have been regularly delivered to AiGrading.

The collectibles will be returned to the address indicated by the Customer during the purchasing process.

7) RIGHT OF WITHDRAWAL OF THE CUSTOMER CONSUMER

Only those Customers who, according to the Italian Consumers Code, are considered to be a consumer (i.e. natural persons who purchases the authentication and/or the grading service for purposes not related to their professional activity who are, therefore, basically those customers who do not hold a VAT number) will be entitled to withdraw from the contract, without the obligation of specifying any reason thereof, within fourteen days from the conclusion of the contract, to be identified with the date of the conclusion of the purchasing process, by downloading and filling out the “withdrawal form” available from the following page of the AiGrading website, or with any other statement explaining the decision to withdraw from the contract, to be sent by mail or email to AiGrading at the contacts provided on the Site.

In the case of exercise of withdrawal by the Customer, the cost of returning the card will be borne by the Customer and will therefore be retained by AiGrading on the total amount of money already paid by the Customer, while the rest of the sum paid by the Customer will be returned together with the Collectible.
