have the legal capacity to sign a contract, or that you are accessing this Site under the supervision of

of these TOU, the User will not be allowed to access this Site or make use of the Services provided through

The access to the Services is reserved to registered Users only. To open an account, it is required a
confirmation of the specific acceptance of these TOU through the so-called "point and click" technique.

Although AiGrading will try to assist Users to the best of its capacities, in the event of loss or theft
of the password to access the Site, AiGrading cannot in any case be held responsible for any damage or
malfunction that Users may suffer due to loss of their password. In any case, Users expressly accept to
be held responsible, within the limits of the law, for all the activities that will be carried out with
their username and password.
Users can access and modify their information at any time, but they declare and confirm that they will
only enter data that are, generally speaking, correct or, in any case, correspond to their personal
identity and to modify this information where they need to be updated.
AiGrading reserves the right, and the User expressly acknowledges and accepts it, to temporarily suspend
or definitively revoke, at any time and without notice, the account of the Users who, at the
unquestionable judgment of AiGrading, has acted in such a way to justify such a measure.
In the public areas of the Site, Users may use pseudonyms or other fictitious identifiers provided they
are neither offensive nor defamatory towards third parties or, in any case, are not prohibited under
Italian or international legislation; moreover, such pseudonyms or fictitious identifiers must not
constitute an illegal appropriation of the identity of third parties. AiGrading reserves the right,
and the User expressly acknowledges and accepts it, to temporarily suspend or definitively revoke, at
any time and without notice, the pseudonym or identifier of Users who are or may be, at its unquestionable
judgement, harmful to the rights and reputation of third parties or are, in any case, contrary to the law.
Any communication made via email, notification via an app., or notice on this Site is considered
"Electronic Communication". Without prejudice to specific legal provisions in this regard, the User
expressly accepts that, for the purposes of these TOU, all contracts, notifications, information and
other communications that AiGrading provides in the forms of "Electronic Communication" satisfy the
requirement of the written form when required by law.
When, within these TOU, it is required that the communications must take place via "PEC"
(certified email with legal value according to Italian law), this requirement will be considered
satisfied only if the communication is sent or received by the following AiGrading PEC:

The AiGrading Site is not accessible and its Services are not provided to minors under the age of 18. Users under the age of 18 may use the Site and/or Services only under the supervision and responsibility of those exercising parental authority or legal representation on them.
In the event of a breach of the TOU by Users, the fact that AiGrading has not brought any action against them does not constitute, nor should it be construed as, a waiver by AiGrading to act for the protection of its interests against the breach of obligations assumed by Users with these TOU.
All content present on, or made available through, this Site, such as, but not limited to, text, graphics, logos, buttons, icons, images, audio files, data collections, and code source, are the property of AiGrading, or of its suppliers or affiliates, and are protected by European and international Italian legislation (in particular, law n. 633 of 1941) regarding the protection of copyright and on the creation of databases. It is not permitted, for any purpose and under any circumstances, to systematically extract and/or reuse parts of this Site or elements contained therein. In particular, it is not permitted to carry out data mining or the extraction of information in order to create new databases or to reuse the images of playing cards or Collectibles to recreate art works of a creative nature.
The use of this Site and/or of the AiGrading app, and/or of any other connected application
or function ("Software") is permitted for the sole purpose of using the Services and not for any other
type of purposes. In particular, the total or partial reproduction, combination with other programs
and/or reuse of the source code of the Software is prohibited. It is also prohibited, except for the
application of mandatory legislation in this regard, any "reverse engineering" procedure and, therefore,
the User may not copy, modify, decompile or disassemble or, in any other way, intervene on the Software,
in full or in part, nor create derivative works based on the Software. Furthermore, the User cannot
encourage or help other subjects to carry out the activities indicated in this article.
The use of the Software can be revoked by AiGrading, at any time and at its unquestionable judgement, for
violation of these TOU and/or for any other illicit use based on Italian, European, international
legislation or other applicable laws.
AiGrading may provide Software updates at any time and without notice, in order to ensure compliance with the Services or to ensure higher standards of IT security. Such changes will be made at no additional cost to Users.
The AiGrading brand is a registered trademark filed with the Italian Patent and Trademark Office and is protected by Italian, European and international legislation on the protection of intellectual property. The use of the AiGrading trademark as well as of the other trademarks present on the Site is prohibited.
The operation of some of the AiGrading Services is based on technical solutions which constitute the intellectual property of AiGrading and which, as such, are protected by Italian, European and international laws. The total or partial reproduction of the technical solutions that allow the functionality of the Services or the combination, or reverse engineering of them and/or of the intellectual property of AiGrading constitutes an illegal action that will be prosecuted in the competent civil and criminal courts.
AiGrading, pursuant to art. 1229 of the Italian Civil Code, will be liable to Users who are not consumers
pursuant to the Italian Consumer Code (Legislative Decree 206/2005), only for non-fulfillment due to
willful misconduct or gross negligence. In any case, and regardless of the category of User, AiGrading
will not be responsible for damages caused by the malfunctioning of the internet or third-party systems
over which it has no control and which have not been caused by its own action.
AiGrading, pursuant to art. 1228 of the Italian Civil Code, will not be liable to Users who are not
consumers pursuant to the Italian Consumer Code (Legislative Decree 206/2005), for the intentional or
negligent act of the auxiliaries. In any case and regardless of the type of User, AiGrading will not be
responsible for damages caused by the malfunctioning of the internet or third-party systems over which it
has no control and which cannot be qualified as auxiliary.
AiGrading will not be responsible for any additional pacts or agreements stipulated between Users and
AiGrading agents and/or affiliates, which are not strictly related to the performance of the Services
and/or to the functioning of this Site.
AiGrading cannot, in any case and under any circumstances, be held responsible for damages deriving from
malfunctions or incorrect settings of equipment and tools owned or used by Users to interact with this
Site and/or to use the Services including but not limited to the personal computer, the Ipad, the
smartphone, the operating system, the browser.
Although these TOU are made available in various languages, only the Italian text will be deemed
authentic in case of a dispute. These TOU are governed by, and have to be construed in accordance with,
the laws of the Republic of Italy.
For Users who are not consumers pursuant to the Italian Consumer Code (Legislative Decree 206/2005),
the court of Padua (Italy) shall have sole competence in relation to any dispute relating to these TOU
and/or the conclusion, interpretation or execution of the contract relating to the Services or to the
navigation and/or use of this Site and/or the Services. For Users who are consumers, according to the
law of the European Union and the rules of the Italian Consumers Code, on the other hand, the competent
court in case of a dispute shall be determined according to the rules of the Italian Consumers Code.
